ELIGIBILITY: The ACE™ “A-Game” Challenge (the “Contest”) is open to legal residents of the contiguous 48 United States and the District of Columbia, who are 13-24 years of age at the time of entry. Minors who enter must have the written consent of a parent or legal guardian in order to be eligible to receive any prizes. Employees, officers, directors and agents of ACE™ Brand (“Sponsor”), Gage Marketing Group LLC, and their respective parent companies, affiliates, subsidiaries, and advertising/promotional agencies, and members of the immediate family or persons living in the same household of such individuals, are ineligible to participate or win a prize. Void in AK, HI and where prohibited by law. Subject to all federal, state and local laws. All eligible individuals as defined herein are referred to as “Entrant”.
HOW TO ENTER: Beginning on 10/07/13 at 12:00:00 p.m. Central Time (“CT”) through 11:59:59 p.m. CT on 11/15/13 (“Contest Period”), a prospective Entrant may enter the Promotion by visiting www.acebrand.com/AGameChallenge or visit the ACE™ Brand Facebook page (www.facebook.com/acebrand) and click on the link to the Sweepstakes page. To access the Sweepstakes page, you must “Like” ACE™ Brand’s page. Entrants will be prompted to indicate that they have read, accept, and agree to be bound by these Official Rules. Entrants must also: A) complete the entry form with all required information, which will include first and last name, email address, street address (no PO boxes), city, state, ZIP code, video title (not to exceed 15 words) and birth year B) Submit one (1) video (“Entry”) supporting the theme “Your Best A-Game”. The A-Game Entry should showcase entrant’s best athletic move, trick or feat. The video may not exceed one minute in length. Limit one (1) entry per person. Once an Entry is submitted, it may not be edited or resubmitted. No correspondence regarding the screening or verification of Entries will be undertaken by Sponsor, except as specified in these Official Rules.
By entering the Contest, you agree to the Official Rules, that your submission is original and does not contain any prohibited content and that your entry may be posted on the Contest website and shared by Sponsor in social media.
ADDITIONAL ENTRY REQUIREMENTS: Each Entry must also comply with the following Submission Guidelines:
- The Entry may not contain any content that is lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, obscene, or that otherwise contains inappropriate content or objectionable material as determined by Sponsor in its sole and unfettered discretion.
- The Entry may not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.
- The Entry may not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where Entry is created.
- The Entry must be the Entrant’s original work, by and/or at the direction of, and must not infringe the copyright, trademark, privacy, publicity, or other intellectual rights of any person or entity.
- If any persons appear in the Entry, the Entrant is responsible for obtaining, prior to sending the Entry, any releases and consents necessary to permit the exhibition and use of the Entry by Sponsor. If any person appearing in any Entry is under the age of majority in their state of residence, appropriate permission by parent/legal guardian may be required.
- The Entry must not contain any personally identifiable information of any person other than the Entrant. Should the Entrant include personally identifiable information about him/herself in his/her Entry, Entrant acknowledges and agrees that such information will be disclosed publicly and Entrant is solely responsible for any consequences thereof.
- The Entry may contain multiple participants, but all participants must be between the ages 13-24 at the time of submission.
- The Entry must not exceed one (1) minute in length.
- The Entry must be in 3GP/3GP2, ASF (Windows Media), Audio Interchange File Format (AIFF), AVI, DV video, MOV (Quicktime), MP4, MPEG2, MPEG-1, RealMedia, VOB (Video Object), or WAV format.
- The Entry must not exceed three hundred (300) MB in size.
- The Entry’s content and title must be in English.
- The Entry must not contain any commercial content or logos.
- The Entry may not have been previously published and may not have won previous awards.
- The Entry may not contain any material or elements that are not owned by the Entrant and/or which are subject to the rights of third parties.
- The Entry cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means.
By submitting your Entry, you agree that your Entry conforms to these Official Rules and that Sponsor, in its sole discretion, may disqualify your Entry for any reason at any time, including if it determines, in its sole discretion, that your Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by Sponsor, in its sole discretion. By submitting an Entry, entrant hereby grants permission for the Entry to be posted on www.acebrand.com/AGameChallenge or other websites. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry. Certain Entries may be used by Sponsor for socializing and promotion purposes during the contest period. Being selected for socializing and/or promotional purposes is unrelated to the Judging Criteria and does not imply or guarantee selection as a prize winner in the Contest.Uploading an Entry constitutes entrant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions, including the names, likenesses and performances embodied therein, in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, Entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Entry.
Round 1: On or about 11/28/13, an independent, qualified panel of judges will judge all eligible Entries received based on the following criteria:
- Content (50%) – How well does video showcase the spirit of a youth athlete performing at their best, giving their all or demonstrating an athletic feat, trick or moment?
- Uniqueness/Technical Skill (25%) – What is the level of uniqueness and/or technical skill involved in the athletic feat, trick or moment
- Production Quality (25%) – Does the quality of the video adequately demonstrate the athletic feat, trick or moment?
The twenty-five (25) highest scoring Entries (provided a sufficient number of eligible entries are received) will advance to Round 2 of judging. In the event of a tie, tied entries will advance to Round 2 of judging. If fewer than 25 eligible entries are received, all eligible entries will advance to Round 2 of judging.
Round 2: The Twenty-five (25) highest scoring Entries from Round 1 of judging will be re-judged on or about 12/02/13, by a second independent, qualified panel of judges based on the same criteria as Round 1.
The five (5) highest scoring Entries (provided a sufficient number of eligible entries are received) will advance to the Final Round of judging and will be re-judged on or about 12/06/13, by a third independent, qualified judge based on the same criteria as Round 1. The Entrant submitting the Entry receiving the top score will be declared the potential Grand Prize winner, subject to verification. The Entrants submitting the two (2) Entries with the next highest scores will be declared potential First Prize winners, subject to verification. In the event of a tie, tie will be broken based upon the highest score for Content and continuing thereafter in each category until the tie is broken.
The judges’ decisions on all matters pertaining to judging, administering and/or interpreting the terms and conditions of this Contest are final. Sponsor reserves the right not to award all if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries. Prize awards are subject to verification of eligibility and compliance with these Official Rules.
Prizes: Grand Prize (1): a $10,000 scholarship awarded in the form a check written in the name of the Grand Prize Winner or parent/legal guardian if winner is a minor. First Prizes (2): $2,500 awarded in the form of a check written in the name of each First Prize Winner or parent/legal guardian if winner is a minor. Prizes are non-transferable except as provided herein or at the discretion of the Sponsor. No prize substitutions except as provided in these Rules. Limit one (1) prize per person. Total ARV of all prizes: $15,000. All prize details are at Sponsor’s sole discretion.
GENERAL: Winners are responsible for payment of any income taxes on prizes under applicable federal, state and local laws. Potential Prize winners will be required to sign and return an Affidavit of Eligibility, Release of Liability, Assignment of Rights and a Publicity Release (where legal), within 10 days of notification. Additionally, if a Grand Prize or First Prize Winner is under 19 in AL/NE or under 18 in contiguous U.S./D.C, his/her parent or legal guardian will be asked to confirm prior permission and consent to Winner’s participation in the Contest and agreement to the Official Rules by co-signing and returning an Affidavit of Eligibility, Release of Liability, Assignment of Rights and a Publicity release as specified in Winner documentation (where legal). In the event of non-compliance with these requirements, prize may be forfeited. In the event that a prize or prize notification is returned as undeliverable, such prize will be forfeited and prize will be awarded to an alternate Entry with the next highest scoring Entry, at the Sponsor’s sole discretion.
By participating, Entrants release 3M, Gage Marketing LLC, their respective parent companies, affiliates, subsidiaries, advertising and promotional agencies and each of their respective directors, officers, agents and employees (Released Parties), from any and all liability with respect to participation in the Contest or the acceptance or use (or misuse) of any prize or any use of the Entry submitted by Sponsor. Entrants agree to release, defend, indemnify and hold harmless (Released Parties) from and against, and accept all responsibility of any kind, including but not limited to financial, for any liability, claims, losses, damages or proceedings, including but not limited for death, (including reasonable attorneys' fees) relating to any actions taken by entrants, including without limitation all warranties relating to participation and entry in the Contest and use of entrant’s e-mail or other identification purporting to act on entrant’s behalf in regard to the Contest (whether or not such use occurred with or without your permission). Entrants also agree to release, defend, indemnify and hold harmless the (Released Parties) from any and all liability, claims, losses, damages or proceedings, including but not limited for death (including reasonable attorneys' fees) relating to Contest prize consideration and Contest publicity, and any other matter in connection with entrants’ participation in the Contest. Except where prohibited by law, by accepting prize, Winners agree to use of their first name and first initial of surname, address (city and state only), Entry and any statements made by Winners regarding the Contest or Sponsor (provided same are true) for advertising or publicity purposes worldwide without limitation, including the internet, and without compensation, and further grants Sponsor any and all rights to said use.
Released Parties are not responsible for lost, late, damaged, delayed, or incomplete Entries, Entries not received by entry deadline, interrupted or unavailable network, server or other connections, mis-communications, failed telephone, computer hardware, software and other technical failures of any kind, including injury or damage to any person's computer relating to or resulting from participating in or experiencing any materials in connection with the Contest, unauthorized human intervention, garbled, jumbled or delayed computer transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information online regardless of cause that may limit a user's ability to participate in the contest. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these official rules. INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION. Use of script, macro or any other automated system to vote is prohibited and all such votes will be void. Sponsor reserves the right to cancel or modify Contest if fraud, misconduct or technical failures compromise the integrity or fairness of the promotion; or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest as determined by Sponsor/judging agency/administrator, in their sole discretion. In the event of cancellation, a notice will be posted online, entries received prior to termination will be judged and prizes awarded from among all eligible, non-suspect entries received prior to the event requiring cancellation. In the event of a dispute regarding the identity of the person submitting an online entry, entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access Provider, online service provider, or other organization (e.g., business, educational institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may require proof to its satisfaction of entrant’s registered subscriber status. Multiple entrants are not permitted to share the same email address. Any attempt by an entrant to obtain more than one (1) entry by using multiple/different email addresses or any other methods will void that entrant’s entries and that entrant may be disqualified.
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for St. Paul, Minnesota or the appropriate Minnesota State Court located in St. Paul, Minnesota; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and/or consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the contest, shall be governed by, and construed in accordance with, the laws of the State of Minnesota.
